Defending an Appeal

What Is An Appeal?

A criminal appeal is a process by which the appellate court reviews decisions of the trial court to determine if harmful error occurred. The appellate process focuses on interpreting law and applying it to the facts found in the trial court. Unlike at the trial level, where one judge presides over the case, at the appellate level, a panel of three judges is assigned to the case.

Defending an Appeal

If you received a successful outcome in a Florida court case, that doesn't mean your court battle is over. The other party will often appeal the decision to a higher court to get the ruling overturned. If you find yourself in this situation, it is important to put together a proper defense against the appeal.

Filing a Cross-Appeal

Even as the appellee, or the respondent to the case being appealed, you may have incentive to file a cross-appeal. While the ruling of the original case came out in your favor, there may be portions of the law that were misapplied or decisions by the court that were applied incorrectly. There is some nuance to determining the value of a cross-appeal and how to file one effectively, which is why it is important to work with experienced lawyers if you are defending an appeal.
