Daytona Beach commissioner facing battery charge

Being charged with battery, or assault of any kind, is not something that should be taken lightly. Any accusation where one person is accused of physically making contact with another person in an attempt to hurt him or her should be taken seriously, as the consequences from a conviction can be far-reaching.

A Daytona Beach commissioner is currently in this position. The 47-year-old is accused of punching another man on the side of his face. The alleged victim in this case is a 66-year-old, which means the commissioner is facing a battery on a person over 65 years old charge. 

In this case, the 66-year-old is also attempting to claim the commissioner was intoxicated. However, police have not charged him with driving drunk, as they did not see him driving. The incident reportedly happened after the commissioner got out of his car. The altercation seems to have stemmed from anger related to driving. 

Knowing he has rights though, the commissioner has hired an attorney. This attorney is already claiming the commissioner is the real victim in this case and claims his client is innocent.

If convicted, WFTV Orlando reports the commissioner could be removed from his position. This removal could be on top of any criminal consequences. 

For the average Florida resident hearing about this case, it is important to keep in mind that being arrested or charged is not the same as being convicted. Additionally, as this commissioner has done, those facing criminal charges have the right to hire an attorney.
